AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ModBlox ("Company," "we," "us," or "our"), concerning your access to and use of the https://modblox.hawkcraftstudios.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and our Discord bot and related services (collectively, the "Service").
You agree that by accessing the Site or using the Service, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service from time to time. We will alert you about any changes by updating the "Effective Date" of these Terms of Service, and you waive any right to receive specific notice of each such change.
The Site and Service are intended for users who are at least 13 years old (or 16 in the European Economic Area). Persons under the age of 13 (or 16 in the EEA) are not permitted to use or register for the Site or Service.

1. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and the Service are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions.
The Content and the Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Service, no part of the Site or Service and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site and Service, you are granted a limited license to access and use the Site and Service and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.
2. USER REPRESENTATIONS
By using the Site or Service, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete
- You will maintain the accuracy of such information and promptly update such registration information as necessary
- You have the legal capacity and you agree to comply with these Terms of Service
- You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site and Service
- You will not access the Site or Service through automated or non-human means, whether through a bot, script, or otherwise
- You will not use the Site or Service for any illegal or unauthorized purpose
- Your use of the Site and Service will not violate any applicable law or regulation
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site and Service (or any portion thereof).
3. USER REGISTRATION
You may be required to register with the Site and Service through Discord OAuth authentication. You agree to keep your authentication credentials confidential and will be responsible for all use of your account. You understand that using another person's account credentials is strictly prohibited. We reserve the right to remove, reclaim, or change a username or Discord integration you select if we determine, in our sole discretion, that such username or integration is inappropriate, obscene, or otherwise objectionable.
4. PROHIBITED ACTIVITIES
You may not access or use the Site or Service for any purpose other than that for which we make the Site and Service available. The Site and Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the Site and Service, you agree not to:
- Systematically retrieve data or other content from the Site or Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information
- Circumvent, disable, or otherwise interfere with security-related features of the Site or Service
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site or Service
- Use any information obtained from the Site or Service in order to harass, abuse, or harm another person
- Make improper use of our support services or submit false reports of abuse or misconduct
- Use the Site or Service in a manner inconsistent with any applicable laws or regulations
- Engage in unauthorized framing of or linking to the Site or Service
- Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Site or Service
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools
- Delete the copyright or other proprietary rights notice from any Content
- Attempt to impersonate another user or person or use the username of another user
- Upload or transmit any material that acts as a passive or active information collection or transmission mechanism
- Interfere with, disrupt, or create an undue burden on the Site or Service or the networks or services connected to the Site or Service
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site or Service to you
- Attempt to bypass any measures of the Site or Service designed to prevent or restrict access to the Site or Service
- Copy or adapt the Site's or Service's software, including but not limited to Flash, PHP, HTML, JavaScript, or other code
- Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site or Service
- Use, launch, develop, or distribute any automated system that accesses the Site or Service, or using or launching any unauthorized script or other software
- Use a buying agent or purchasing agent to make purchases on the Site or Service
- Make any unauthorized use of the Site or Service, including collecting usernames and/or email addresses of users by electronic or other means
- Use the Site or Service as part of any effort to compete with us or otherwise use the Site and/or the Service and/or the Content for any revenue-generating endeavor or commercial enterprise
- Use the Site or Service to advertise or offer to sell goods and services without our express written consent
- Sell or otherwise transfer your profile or account
- Violate Discord's Terms of Service or Community Guidelines
- Abuse webhook functionality, including but not limited to: exceeding rate limits through circumvention attempts, using webhooks for spam or harassment, sharing webhook URLs with unauthorized parties, or using encrypted webhook URLs outside of our Service
- Attempt to decrypt, reverse engineer, or otherwise access encrypted webhook URLs or other encrypted data stored by the Service
- Bypass or attempt to bypass role-based access controls, rate limiting, or other security features
5. USER GENERATED CONTRIBUTIONS
The Site and Service may allow you to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site or Service ("Contributions"). When you create or make available any Contributions, you represent and warrant that your Contributions comply with all applicable laws and do not infringe any third-party rights.
Any use of the Site or Service in violation of the foregoing violates these Terms of Service and may result in termination or suspension of your rights to use the Site and Service.
6. CONTRIBUTION LICENSE
By posting your Contributions to any part of the Site or Service, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions for any purpose, commercial, advertising, or otherwise.
We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights associated with your Contributions. You are solely responsible for your Contributions to the Site and Service.
7. SERVICES AND BILLING
7.1 Free Services
Our basic Service is provided free of charge and includes:
- Discord bot functionality
- Basic moderation features
- Dashboard access
- Basic anti-raid protection
- Basic automod capabilities
- Webhook management with encrypted URL storage
- Multi-server moderation synchronization
- Role-based webhook access control
7.2 Premium Services
We offer premium subscription tiers that provide additional features and capabilities. Premium services are billed on a recurring basis (monthly or annually) as selected during the subscription process.
7.3 Pricing and Payment
- All fees are exclusive of applicable taxes
- Subscription fees are billed in advance on a recurring basis
- Payment is processed through Stripe, our third-party payment processor
- You are responsible for providing accurate and current billing information
7.4 Subscription Renewal and Cancellation
- Your subscription will automatically renew unless you cancel before the renewal date
- You may cancel your subscription at any time through your account dashboard
- Cancellations take effect at the end of the current billing period
- No refunds are provided for partial billing periods, except where required by law
7.5 Changes to Pricing
We reserve the right to modify our pricing at any time. Price changes will be communicated to you at least 30 days in advance. If you do not agree to a price change, you may cancel your subscription before the change takes effect.
8. SUBMISSIONS
Any feedback, comments, ideas, or suggestions you provide to us regarding the Site or Service become our sole property. We may use such submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
9. THIRD-PARTY WEBSITES AND CONTENT
The Site and Service may contain links to third-party websites or content. We are not responsible for the accuracy, content, or practices of third-party websites. You access third-party websites at your own risk and should review their terms and policies.
10. DISCORD INTEGRATION
Our Service integrates with Discord, a third-party communication platform. Your use of Discord is subject to Discord's Terms of Service and Privacy Policy.
By using our Service, you acknowledge and agree that:
- We are not affiliated with, endorsed by, or sponsored by Discord, Inc.
- We access Discord's platform through their official API
- You grant us permission to access your Discord account data as necessary to provide the Service
- You are responsible for compliance with Discord's Terms of Service and Community Guidelines
11. SITE AND SERVICE MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Site and Service for violations of these Terms of Service; (2) take appropriate legal action against anyone who violates these Terms; (3) restrict access to or disable any Contributions; (4) remove content that is excessive in size or burdensome to our systems; and (5) manage the Site and Service to protect our rights and property.
12. PRIVACY POLICY
We care about data privacy and security. By using the Site or Service, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Service. The Site and Service are hosted in the United States and other jurisdictions. By using the Service, you consent to the transfer of your data to the United States.
13. TERM AND TERMINATION
These Terms of Service shall remain in full force and effect while you use the Site or Service.
WE RESERVE THE RIGHT TO DENY ACCESS TO AND USE OF THE SITE AND SERVICE TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING FOR BREACH OF THESE TERMS OF SERVICE OR ANY APPLICABLE LAW.
If we terminate or suspend your account, you are prohibited from registering and creating a new account. We may take appropriate legal action, including pursuing civil, criminal, and injunctive redress.
14. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Site and Service at any time without notice. We may experience interruptions, delays, or errors and reserve the right to modify or discontinue the Service without liability to you.
15. GOVERNING LAW
These Terms of Service and your use of the Site and Service are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
16. DISPUTE RESOLUTION
16.1 Informal Negotiations
To expedite resolution and control costs, the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.
16.2 Binding Arbitration
If informal negotiations fail, the Dispute will be finally and exclusively resolved through binding arbitration. The arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA).
Except where otherwise required by applicable law, the arbitration will take place in Montreal, Quebec, Canada.
If arbitration is not possible, the Dispute shall be commenced or prosecuted in the courts of competent jurisdiction located in Montreal, Quebec, Canada, and the Parties consent to jurisdiction in such courts.
16.3 Restrictions
Any arbitration shall be limited to the Dispute between the Parties individually. There is no right or authority for any Dispute to be arbitrated on a class-action basis.
16.4 Exceptions
The following Disputes are not subject to arbitration: (a) any Disputes seeking to enforce or protect intellectual property rights; (b) any Dispute related to theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
17. CORRECTIONS
There may be information on the Site or Service that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time, without prior notice.
18. DISCLAIMER
THE SITE AND SERVICE ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND/OR SERVICE WILL BE AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
19. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICE.
OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
20. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Site or Service; (3) breach of these Terms of Service; (4) breach of your representations and warranties; (5) your violation of the rights of a third party, including intellectual property rights; or (6) any harmful act toward another user of the Site or Service.
21. USER DATA
We will maintain certain data that you transmit to the Site or Service for managing performance and your use. Although we perform regular backups, you are solely responsible for all data you transmit or relating to any activity using the Site or Service. You agree that we shall have no liability for any loss or corruption of such data.
22. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS.
23. CALIFORNIA USERS AND RESIDENTS
If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.
24. EUROPEAN UNION USERS
24.1 Withdrawal Right
If you are a consumer based in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement.
24.2 Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day we are informed about your decision to withdraw.

25. MISCELLANEOUS
These Terms of Service constitute the entire agreement between you and us. Our failure to exercise any right or provision shall not operate as a waiver. If any provision is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us.
